Last month, the Equalities, Human Rights and Civil Justice Committee at the Scottish Parliament launched an inquiry into Civil Legal Aid in Scotland, calling for views from stakeholder groups.

We were invited to share views on the state of the current civil legal aid system in Scotland, and what changes could be made in the short and longer term to address access issues. 

HRCS has argued that Scotland’s civil legal aid system is in crisis; underfunded, inaccessible, and outdated.

We call for urgent, systemic reform grounded in human rights standards, including expanded eligibility, broader scope of coverage, fair solicitor remuneration, and structural change to address “legal aid deserts.”

Incremental fixes are inadequate, and bold legislative reform is essential to ensure equal access to justice for all.
